Roomscan ("Roomscan", "we", "us") operates a digital platform that connects individuals seeking remote apartment verification services ("Renters") with independent individuals who perform on-site visits and produce structured written reports ("Verifiers"). Roomscan does not itself visit, inspect, certify, or evaluate any property in its capacity as platform operator.
These Terms of Service ("Terms") govern your access to and use of the Roomscan platform, including its website, any mobile applications, and any related services (together, the "Platform"). By registering an account, placing a Booking, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms are provided in English. Where a translation is made available, the English version shall prevail in the event of any conflict, subject to mandatory requirements of applicable law.
The following terms have the meanings set out below throughout these Terms.
2.1 Eligibility To use the Platform you must: be at least 18 years of age; have the legal capacity to enter into binding contracts in your jurisdiction; not be prohibited by law from using the Platform or receiving our services; and provide accurate, current, and complete information during registration and throughout your use of the Platform.
2.2 Registration Full use of the Platform, including placing Bookings, requires prior registration. By submitting the registration form, you offer to enter into a user agreement with Roomscan on the basis of these Terms. Roomscan accepts the registration by sending a written confirmation. Roomscan is not obliged to accept any registration.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. If you suspect unauthorised use of your account, you must notify Roomscan immediately at hello.roomscan@gmail.com and change your password without delay.
2.3 Pilot Phase Roomscan is currently operating in a limited pilot phase in Portugal. The geographic availability of the Platform, the number of Verifiers, and the range of features may be restricted and may change during this period. The pilot phase does not alter or reduce any rights available to users under Applicable Law. These Terms and all obligations contained in them apply in full from the date of acceptance.
If Roomscan suspends or discontinues the Platform for reasons unrelated to user conduct, any confirmed Bookings for which a Report has not yet been delivered will be refunded in full within 14 days.
3.1 Platform operator Roomscan operates exclusively as a digital intermediary. Roomscan's role is limited to: providing and maintaining the Platform infrastructure; facilitating the connection between Renters and Verifiers; providing a structured template to assist Verifiers in documenting their independent observations; processing payments and disbursing Verifier Compensation; and providing complaints support as described in § 9.
The structured template provided by Roomscan sets out areas for observation. It does not determine the Verifier's conclusions, judgments, or findings. The content of each Report reflects the independent personal observations of the individual Verifier.
3.2 What Roomscan is not Roomscan is not, and must not be construed as: a landlord, lessor, or party to any tenancy agreement; a licensed real estate agent or property broker under Lei n.º 15/2013 or any equivalent legislation; a property inspector, surveyor, building engineer, or technical expert; a guarantor of the condition, quality, safety, habitability, or legal status of any property; a legal, financial, or investment advisor; or a party to the contractual or commercial relationship between a Renter and any landlord or property owner.
3.3 No verification of third-party information Roomscan does not verify and makes no representation regarding: the ownership, title, or encumbrances on any property; the existence or validity of any planning permission, building permit, habitability licence, or regulatory approval; the accuracy of any listing, advertisement, or description provided by landlords or third parties; or the legal compliance of any rental arrangement under Portuguese or applicable law.
4.1 Independent personal capacity Verifiers are independent individuals who act in their own personal capacity under the Verifier Terms. Each Verifier bears personal responsibility for the on-site visit they conduct and the Report they produce. Nothing in these Terms or in any other aspect of the Platform creates or implies an employment relationship, agency relationship, partnership, or joint venture between Roomscan and any Verifier.
Roomscan applies reasonable criteria when admitting Verifiers to the Platform, including acceptance of the Verifier Terms and completion of an onboarding process. Roomscan may suspend or remove a Verifier who produces materially deficient Reports or who breaches the Verifier Terms. The application of these criteria does not make Roomscan the employer or principal of any Verifier.
4.2 Pilot phase – Roomscan personnel as Verifiers During the pilot phase, on-site visits and Reports may be performed and produced by individuals who are also members, employees, or representatives of Roomscan. Where this is the case, the relevant individual acts in their personal capacity as a Verifier under the Verifier Terms and not in their capacity as a representative of Roomscan as platform operator. The roles of platform operator and Verifier remain legally and contractually distinct.
The liability of Roomscan as platform operator is governed by § 8 of these Terms. The liability of any individual acting as a Verifier, including any individual who is also connected to Roomscan, is governed by the Verifier Terms and by applicable law governing personal liability. Roomscan as platform operator does not assume the personal liability of any individual Verifier, including individuals connected to Roomscan, by virtue of that connection alone.
4.3 Verifier responsibilities Each Verifier is personally responsible for: the accuracy, completeness, and honesty of the Report they produce; performing the on-site visit with reasonable care and diligence; complying with the Verifier Terms; holding any licences, permits, or authorisations required by applicable law; and their conduct during property visits.
4.4 Roomscan's limited liability for Verifier conduct Roomscan is not liable for any act, omission, error, subjective judgment, or misconduct of a Verifier in the performance of an on-site visit or the production of a Report, except: (a) where Roomscan failed to apply its own published Verifier admission criteria in onboarding the relevant Verifier; or (b) where mandatory Applicable Law requires otherwise.
Where a Report is found to have been produced fraudulently or without an actual on-site visit, and Roomscan is notified of this, Roomscan will investigate, suspend the relevant Verifier account pending the outcome, and, where fraud is confirmed, offer the Renter a full refund of the Service Fee and arrange a replacement visit at no additional cost. The liability cap set out in § 8.3 does not apply in cases of confirmed Report fraud.
5.1 Nature of the Report Each Report begins with the following statement, which forms part of the Report and these Terms: "This Report reflects the personal observations of the Verifier at the time of the visit. It is not a professional inspection, a structural survey, or a certification of any kind. It is provided as a contemporaneous, subjective account of the property's visible condition on the date stated."
The Report constitutes: a contemporaneous and subjective account of the property's visible condition at the time of the visit; photographic and/or video records of observable features as selected by the Verifier; and responses to the areas identified in Roomscan's structured template, based on the Verifier's personal observations.
5.2 Limitations of the Report The Report does not constitute and is not intended to be: a professional survey, structural survey, or engineering inspection; a legal assessment of the property's compliance with planning, building, or tenancy regulations; a guarantee, warranty, or certification of the property's condition, safety, or suitability for any purpose; a comprehensive inspection, given that not all features, defects, or issues may be visible, accessible, or observable during a single visit; or a reliable indicator of the property's condition at any time other than the date and time of the visit.
5.3 Snapshot in time The property's condition may change between the date of the on-site visit and the date of any subsequent tenancy. Neither Roomscan nor the Verifier accepts responsibility for changes occurring after the visit.
5.4 Renter's responsibility The Renter acknowledges that the Report is one source of information among several and that the Renter bears sole responsibility for conducting appropriate due diligence before entering into any tenancy agreement. Roomscan recommends that Renters obtain independent legal and professional advice before committing to any rental arrangement.
By using the Platform as a Renter, you agree to:
7.1 Service Fee The Service Fee for each Booking is displayed on the Platform prior to confirmation. All fees are stated in euros and are inclusive of applicable taxes. By confirming a Booking, the Renter authorises the full Service Fee to be charged immediately. The Service Fee comprises the Platform Fee and the Verifier Compensation.
7.2 Payment processing Payments are processed through third-party payment processors. Roomscan is not responsible for errors, delays, or failures attributable to third-party processors or financial institutions. The Renter's contractual relationship with any payment processor is separate from these Terms.
7.3 Verifier Compensation Roomscan disburses the Verifier Compensation to the Verifier following submission of a completed Report. Roomscan deducts the Platform Fee from the Service Fee prior to disbursement.
7.4 Refunds The following rules apply to refunds:
7.5 Disputed Reports If the Renter believes a delivered Report is materially incomplete, or that the Verifier did not attend the property, the Renter may submit a formal dispute to Roomscan within 72 hours of Report delivery in accordance with § 9. Roomscan may, at its reasonable discretion, offer a partial refund of the Platform Fee or arrange a replacement visit. Roomscan is not obliged to refund fees on the basis that the Report's content was unfavourable or that the property did not meet the Renter's expectations.
7.6 Consumer right of withdrawal Where Applicable Law grants a statutory right of withdrawal from contracts for digital services, this right may be exercised only before the Verifier has commenced the on-site visit. Prior to confirming a Booking, the Renter will be asked to confirm the following by ticking a checkbox: "I request that Roomscan begin providing the service immediately. I acknowledge that once the on-site visit has commenced, the service is in performance and I will lose my right of withdrawal under applicable consumer law." Confirmation of a Booking without ticking this checkbox is not possible. By ticking the checkbox, the Renter expressly consents to early performance and acknowledges the resulting loss of the withdrawal right to the extent permitted by Applicable Law.
7.7 Chargebacks The Renter agrees not to initiate a chargeback or payment dispute with their payment provider in respect of any Booking for which a Report has been delivered, without first completing the internal dispute process described in § 9. Misuse of chargeback procedures may result in account suspension.
8.1 Platform provided as available The Platform is provided on an as-is and as-available basis. Roomscan makes no warranties, express or implied, regarding the Platform's availability, reliability, or fitness for a particular purpose, except as expressly required by Applicable Law.
8.2 Report accuracy Roomscan does not warrant the accuracy, completeness, or fitness for purpose of any Report. Reports are produced by independent Verifiers and reflect personal observations made at a specific point in time. Roomscan does not review or validate the substantive content of Reports prior to delivery.
8.3 Limitation of Roomscan's liability as platform operator To the maximum extent permitted by Applicable Law, Roomscan's total aggregate liability to a Renter arising out of or in connection with any single Booking, whether in contract, tort, breach of statutory duty, or otherwise, shall not exceed the higher of: (a) three times the Service Fee actually paid by the Renter for the Booking giving rise to the claim; or (b) EUR 250.
Roomscan shall not be liable for: loss of profit, revenue, business, or anticipated savings; loss or corruption of data; any indirect, special, incidental, or consequential losses; any loss arising from the Renter's decision to enter into or not enter into a tenancy agreement; or any loss arising from changes in the property's condition after the Verifier's visit.
The cap in this § 8.3 does not apply in cases of confirmed Report fraud as described in § 4.4.
8.4 Non-excludable liability Nothing in these Terms limits or excludes Roomscan's liability for: death or personal injury caused by Roomscan's own negligence; fraud or fraudulent misrepresentation by Roomscan; or any liability that cannot lawfully be excluded or limited under Applicable Law, including mandatory consumer protection rights under Portuguese law and EU consumer law.
8.5 Verifier's personal liability The limitation in § 8.3 applies solely to Roomscan in its capacity as platform operator. It does not limit or cap the personal liability of any individual Verifier arising from the performance of an on-site visit or the content of a Report. Claims against a Verifier are governed by the Verifier Terms and by applicable law.
9.1 Internal complaints process Renters with a complaint about a Booking or a Report must submit a written complaint to Roomscan at hello.roomscan@gmail.com within 72 hours of the event giving rise to the complaint. Roomscan will acknowledge receipt within 2 business days and will provide a substantive written response within 10 business days.
9.2 Suspension decisions Where Roomscan suspends or restricts a user's account, the affected user may challenge that decision through the internal complaints process described in § 9.1 within 14 days of receiving notice of the suspension. Roomscan will review the challenge and provide a written response within 10 business days. Roomscan will provide written reasons for any suspension as soon as reasonably practicable following the suspension taking effect.
9.3 Portuguese consumer dispute resolution For unresolved disputes with consumers, Roomscan participates in the alternative dispute resolution system available through the Portuguese Consumer Arbitration Centre (Centro de Arbitragem de Conflitos de Consumo, CIAC) or the relevant territorial equivalent. Further information is available at www.consumidor.gov.pt.
9.4 EU Online Dispute Resolution Renters who are consumers resident in the European Union may also submit a complaint to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Roomscan's contact email for ODR purposes is hello.roomscan@gmail.com.
You agree to indemnify, defend, and hold harmless Roomscan and its directors, officers, and contractors from and against any claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from or relating to: your use of the Platform in breach of these Terms; any Content you submit that is false, misleading, defamatory, or unlawful; your violation of any Applicable Law; or any dispute between you and a third party, including any landlord, in connection with a property assessed through the Platform.
You must not use the Platform to:
12.1 Content moderation Roomscan is not obliged to monitor user Content on an ongoing basis. Roomscan reserves the right to review, remove, or refuse to publish any Content that Roomscan reasonably believes to be false, defamatory, abusive, illegal, or in breach of these Terms.
12.2 Account suspension Roomscan may suspend or restrict access to an account immediately and without prior notice where Roomscan reasonably suspects fraud, material breach of these Terms, illegal conduct, or conduct likely to cause harm to other users or third parties. Roomscan will provide written notice of the suspension and the reasons for it as soon as reasonably practicable. The affected user may challenge the suspension under § 9.2.
12.3 Termination by Roomscan Roomscan may terminate a user account with 14 days' prior written notice for any material, continuing, or repeated breach of these Terms. Termination does not affect any accrued rights or obligations of either party.
12.4 Termination by user You may close your account at any time by contacting Roomscan at hello.roomscan@gmail.com. Closing your account does not entitle you to a refund of fees paid for Bookings already confirmed or Reports already delivered.
All intellectual property rights in the Platform, including its design, software, trade marks, and Content produced by Roomscan, are owned by or licensed to Roomscan. Nothing in these Terms grants you any rights in Roomscan's intellectual property beyond those necessary to use the Platform as permitted by these Terms.
By submitting Content to the Platform, including Reports, you grant Roomscan a non-exclusive, worldwide, royalty-free licence to store, process, display, and use that Content solely for the purpose of operating the Platform and fulfilling Bookings. This licence does not extend to the use of your Content for commercial marketing purposes without your prior consent.
Roomscan is the data controller for personal data collected in connection with account registration and the use of the Platform. Roomscan processes personal data in accordance with its Privacy Policy, available at Privacy Policy, which forms part of these Terms by reference.
Reports and related Content, including photographs and video, may contain personal data of third parties such as landlords, occupants, or other individuals present at the property. Verifiers are required under the Verifier Terms to ensure that the capture and submission of such data is carried out in accordance with GDPR and applicable Portuguese data protection law. Renters may not use personal data contained in a Report for any purpose other than evaluating the relevant property for their own personal rental decision.
Roomscan may amend these Terms at any time. Material changes will be communicated to registered users by email and by notice on the Platform at least 14 days before taking effect. Continued use of the Platform after the effective date of an amendment constitutes acceptance of the revised Terms. The current version of these Terms is always available at Terms of Service.
These Terms are governed by the laws of Portugal. Any dispute that cannot be resolved through the process described in § 9 shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, subject to any mandatory provision of Applicable Law that confers jurisdiction on the courts of a consumer's country of habitual residence.
For consumers resident in the European Union, the mandatory consumer protection provisions of their country of habitual residence apply in addition to Portuguese law where those provisions are more favourable to the consumer.
Entire agreement. These Terms, together with the Privacy Policy and the Verifier Terms where applicable, constitute the entire agreement between you and Roomscan in respect of the Platform and supersede all prior representations and understandings.
Severability. If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable, or severed from the Terms. All remaining provisions continue in full force and effect.
Waiver. No failure or delay by Roomscan in exercising any right under these Terms constitutes a waiver of that right.
Assignment. Roomscan may assign its rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of assets with 30 days' prior written notice. You may not assign your rights without Roomscan's prior written consent.
